We request you to please read and understand the terms and conditions, set out below prior to booking a trip with us. We recommend that you also please read the tour details sent to you prior to availing our booking service to ensure that you understand the travel itinerary and physical demands of the trip you are undertaking.
1. Our contract
This agreement is in between you and AusIndia Travel ( ABN- 1-863-042-2021). By booking a trip with us, you agree to these booking conditions. Your booking confirmation invoice should display the services that are to be provided to you.
2. Your details
For confirmation of your traveling details, you must provide all the details asked by your agent such as full name as per passport and in some cases passport number, expiry date and date of issue of your passport, nationality, date of birth. You must also intimate us about any pre-existing medical conditions or illnesses that you may have which may affect your ability to travel and complete your travel commitment. We cannot allow you on some of the trips that are physically demanding in nature without assurance.
3. Booking Deposit
If the case of a group booking $300 per person is the deposit amount,that is non-refundable however in some cases transferable to other group booking subject to that particular group terms and conditions. If your booking is made within 59 days of the departure date, then the full amount is payable at the time of booking.
4. Prices & Surcharge:
All prices are subject to change without prior notice based on availability and can be removed or varied without intimation. Only prices paid in full are guaranteed.Reasons for price changes can be outside factors such as currency fluctuations, fuel surcharges, taxes and airfare increases, which may increase the cost of product and service. Please remember prices are subject to change and confirmed at the time of booking.
5. Changes, Cancellation and Refund:
Fees and extra charges may apply where booking is changed and when the documentis reissued. Changes fee is normally $200 per person, however, varies case by case. In some cases, thedeposit is not refundable for previous booking and in some case can be transferred to new booking, Airfare is based on individual fare conditions as well and sometimes fully non-refundable. We will not provide a refund toyou until wereceive the appropriate funds from the relevant supplier. Bookings that have been cancelled may incur charges. up to 100% of the cost of the booking may be counted as these charges in some cases whether travel has commenced or not, you agree to indemnify us for the amount of that fee or charge.
If you cancel a trip:
Airfare is fully non-refundable,and Deposit of $300 is retained after land booking
- between 31 and 55 days prior to departure, either the deposit or 60% of the totalbooking amount, whichever is greater, will be retained, and
- 100% of the amount paid in connection with your booking will be retained 30 days or less prior to departure.
note that an entirely different set of terms and conditions may be applicable for some trips.
6. Cancellation by us
A trip may stand cancelled at any time prior to departure if factors like terrorism, natural disasters or events outside of our control result in the trip being unviable. If the cancellation of any trip is from our side, you will be refunded the full amount or, you can transfer the same amount to change your trip date. If external circumstances are the reason for cancellation, however, refunds of only a certain amount barring any unrecoverable cost will be provided. We will not be held responsible for any expenses that you may have incurred that include but are not limited to vaccinations, visa applications and travel insurances. Please note that different terms and conditions may be applicable for some trips, you may seek the advice of your booking consultant in this case.
7. Special Requests
AusIndia travel must be intimated at the time of booking in writing if special requests including meal plans, room booking and flight seats are required. We do not guarantee that these requests will be completed, but AusIndia travel will try its best to make them available.
8. Liability & Agency:
We do not accept any liability in contract or otherwise, to the extent permitted by law, for any additional expenses, delays, injuries or loss or any form of inconvenience caused by acts, omissions or faults, caused directly or indirectly, negligent or otherwise, of the third parties who we do not have any control over or due to any circumstance that we do not have control over and which is not preventable by our intervention based on reasonable diligence. Under situations or circumstances where our liability or otherwise cannot be excluded, and where liability may be lawfully limited, such liability is limited to the value of the purchased travel arrangements. We act as an agent in most cases. We sell travel related products on behalf of numerous accommodation, transport and other service providers such as hotel, airline, cruise, rail etc. Our contract obliges us to make travel bookings and organize further contracts between you and third-party service. We will not be held responsible for and nor do we guarantee any representation regarding their standard. Your legal appeal for travel services and possible remedy is against the specific third party provider and not us.All bookings are made on your behalf subject to the terms and conditions of the company and limitations based on the liability imposed by these third party service providers. If for any reason ( barring any fault by us) and travel service provider, who is a third party and in no way related to our organization, is unable to provide satisfactorily the service for which you have been contracted, your recourse lies against that specific provider and not with us.
9. Behaviour:
It is the Clients’ responsibility to ensure that he/she and accompanying travelers or members of the same party do not indulge in behaviour that may cause disrest, unease or danger to others or which may damage or disrupt property belonging to others. Under such circumstances all suppliers (e.g. hotel managers, airline pilots or any other third party service provider) and the Company hold the right to immediately terminate bookings and arrangements made on the Clients’ behalf, in which case the Company responsibilities towards the Client cease immediately. Therefore, the Company will not be held liable for any refunds, compensation amounts or reimbursement of any expenses incurred as a result. Further, the Client will be held liable to compensate the Company for any expenses, whatsoever, that it incurs due to the Client’s behaviour.
10. Passport and visas and Travel Insurance
You must carry a valid passport and should have obtained all of the necessary visas, certificates and permits for the country or countries for which you have booked the trip for. The validity of your passport must be for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct documents including visas, permits and Travel Insurance for your trip. We will not be held responsible if you are refused entry to a country due to lack the correct passport, visa or other necessary travel documentation and also any damage incase you don’t carry travel insurance is your responsibility only.
11. Optional activities
Optional activities not explicitly mentioned on the trip itinerary in the trip price do not any part of the trip or this travel contract. You accept that any assistance or help given to you by your group leader or any local representative and/or people in the arrangement of optional activities does not render us liable for them in any way. The contract for the provision of that particular activity or activities will be between you and the provider of the activity.
12. Claims & Complaints
If you have any grievances or complaints about your trip, please intimate your group leader or our local representative at the time for attempts at rectifying the complaint or fault. If satisfaction is still not reached by these means, then any further complaints should be given in written format to us within 30 days of the completion of the tour explicitly mentioning your grievance.

14 .Images and Videos:
Hotel images featuredin our website and related brochure are used for illustration purposes only. Your specific hotel (where hotel accommodation is included as part of your chosen tour) may differ from the representation provided. Clients agree that any images or videos taken of their likeness while being a participant on the tour organized by the Company or through the supply of image or images by fellow clients may be utilized in any form of media for the Company.
15. Privacy Policy
In order to process your booking, the Company needs to collect some crucial personal details from you. Usually, these include the names along with the addresses of party members, any form of payment details including credit/debit details and special requirements including those relating to any form of disability or prevent existing medical condition that may affect the arrangements. We take full responsibility for making sure that proper security measures and mechanisms are in place to protect your privacy and information.
We will need to pass some information forward to the relevant suppliers of your travel bookings(airlines, hotels, transport companies etc.). These suppliers may be outside continental Europe if your travel bookings are to take place or involve parties from outside these countries. The information may also be forwarded to companies involved in checking of security or credit, public authorities like the customs/immigration if required by them, or as required by laws.
The Company will only deal with the personal details you give to the Company as stated above unless you explicitly agree otherwise. We may make contact with you or members of your party by the means of post, e-mail, or telephone for the purposes explained. We will also utilize your information to intimate you of offers in the future or to send you company brochures. If you do not wish to receive such advances in the future then do let us know as soon as possible by the means of telephone, letter or e-mail us at info@ausindiatravel.com.au.
16. .Local Laws:
All participants in tours organized by the Company are expected to obey the laws and regulations of the countries being visited and any failure to do so will relieve the Company of all obligations towards the client and result in termination of contract.
17. Updating of Terms and conditions
The rights to update and/or alter these terms are reserved exclusively by the Company and the conditions may be altered at any time without prior notice, and it is the Clients duty to be familiar with these altered terms and conditions. The latest terms and conditions of the Company canbe found on the Company website www.ausindiatravel.com.au and will supersede any previous version.
Acknowledgement- You are 18 years of age or older and fully agree and undertand all above Terms and Conditions.
